Terms & Conditions

1) Driver Licenses

The hirer must be over the age of 21, have a valid license and carry it on them at all times whilst driving. Only the persons described in the above agreement may drive the vehicle. Overseas licenses are accepted in New Zealand but it must be in English or have an English translation.

2) Costs and Cancellations

Payment is to be made in full upon booking – or if a deposit has been taken the balance is due before at pick up. Unless otherwise informed, full payment will be taken on pickup via card (with a 3% surcharge).

If cancellation is before 28 days of the pick-up date allows a full refund minus 10% admin fee. If cancellation is within 28 days of the pick-up date, 25% of the gross rental will be forfeited. If cancellation is within 14 days of the pick-up date, 50% of the gross rental will be forfeited. If cancellation is within 7 days of the pick-up date, 100% of the gross rental will be forfeited. No refund for early return.

CamperCo accepts MasterCard & Visa based cards, cash and direct debit payments. All transactions are in NZ dollars and CamperCo is unable to accept responsibility for exchange rate fluctuations or bank fees which could vary the amount refunded or charged compared to the quote received. 

3) Vehicle Pick Up and Drop Off 

The vehicles will be available for pick up at 10am on the first day of hire.  They are to be returned on the agreed date at the nominated depot before 3pm on the last day of hire. 

Late returns will incur a fee of $50 per hour to 7pm, after which four day’s extra payment will be charged for each day the campervan is absent, if no extension has been authorised.

4) Rental Duration & Extensions

Extensions may be organized subject to availability, at the current rental rate. If the campervan is returned early for any reason after it has been used the hirer may not be entitled to a refund.

5) Use of the Vehicle

The hirer shall not:

a) use or allow the vehicle to be used for the transport of passengers for hire or reward unless the vehicle is hired with the operator’s knowledge for use in a passenger service licensed under Part 4A of the Land Transport Act 1998 (“the Act”);

b) Sublet or hire the vehicle to any other person without the operator’s permission to do so;

c) Allow the vehicle to be used outside his/her authority;

d) Operate the vehicle or allow it to be operated in circumstances that constitute an offence against any of Sections 56, 57 and 58 of the Act;

e) Operate the vehicle or allow it to be operated in any race, speed test, rally or contest;

f) Operate the vehicle or allow it to be operated to propel or tow any other vehicle;

g) Operate the vehicle, or allow it to be operated in breach of the Act, the Transport Act 1962, the Land Transport (Road User) Rule 2004, or any other Act, regulations, rules or bylaws relating to road traffic;

h) Use the vehicle to carry a child without the use of an approved child restraint (as defined in the New Zealand road laws);

i) Drive or allow the vehicle to be driven by any other person if at the time of driving the vehicle the driver does not hold a current driver’s licence appropriate for the vehicle;

j) Drive or allow the vehicle to be driven on any roads excluded in section 8 of this agreement, or on any beach, driveway or surfaces likely to damage the vehicle; or

k) Allow the vehicle to be driven by any person who is not named or described in this agreement as a person permitted to drive the vehicle.

l) Exceed the speed limit.

6) Hirer’s Obligations

 The hirer shall ensure that:

a) all reasonable care is taken when driving and parking the vehicle;

b) the water in the vehicle’s radiator and battery are maintained at the proper level;

c) the oil in the vehicle is maintained at the proper level;

d) the tyres are maintained at their proper pressure;

e) the vehicle is locked and secure at all times when it is not in use;

f) no part of the engine, transmission, braking or suspension systems are interfered with;

g) should a warning light be illuminated or the hirer believes the vehicle requires mechanical attention, s/he stops driving and advises the operator immediately.

h) no smoking will take place inside the vehicle.

i) no animal will be transported in the vehicle.

7) Insurance & Excess

All CamperCo vehicles carry 1st and 3rd party insurance included in the daily hire price. To ensure the hirer is always covered they must be over 21 years of age, carry their license at all times and abide by the terms in section 5 of this Agreement.

You will be covered for the cost of damage to third party property or to the rented vehicle for a single vehicle accident, including theft or attempted theft, vandalism, and fire. If the accident is deemed your fault you may be liable for the cost of hiring while the vehicle is under repair, and/or towage costs to our depot. The insurance does not extend to the items that belong to the hirer which is why we recommend travel insurance.

Any accident must be reported to CamperCo, Failure to do so will void any extra insurance purchased, and you will be charged our standard insurance excess. If anyone is hurt or there is a dispute over accident liability then you should also contact the New Zealand Police. As per the insurer’s terms and conditions, camperco will hold the full excess amount against the card of the primary hirer until a claim is complete – at which time a refund (if any) will be processed.

If an accident occurs where a third party is at fault, you will either be provided with a replacement campervan, or refunded for the days you lose from the hire period. If you are deemed at fault then the remaining hire charge will not be refunded.

The excess amounts you may be liable for should an insurance claim occur, are as follows:

  • $4,000 excess for drivers over 25
  • $5,000 excess for drivers 21 to 25

You can reduce your excess to zero by paying an extra amount per day, which depends on your age. This means that if there is an insurance claim that complies with the insurance conditions outlined above, you are not liable to pay any excess. These charges are in addition to the daily hire rate and can be selected while making a booking.

  • Drivers Over 25
    $35 per day (capped at $700 maximum)
  • Drivers Aged 21 – 25
    $40 per day (capped at $800 maximum)

Zero excess insurance is valid for one claim following which the hirer may choose to take out a second zero excess policy for the daily price relevant to their age group. Each policy is valid for one claim only. Failure to advise CamperCo of any accident or damage in a timely fashion will void any policy and our standard insurance excess will apply.

8) Insurance Exclusions

 The hirer acknowledges that the cover referred to above will not apply when:

a) the driver of the vehicle is under the influence of alcohol or any drug that affects his/her ability to drive the vehicle;

b) the vehicle is in an unsafe or un-roadworthy condition, such condition arising during the course of the hire, that caused or contributed to the damage or loss, and the hirer or driver was aware or should have been aware of the unsafe or unroadworthy condition of the vehicle;

c) the vehicle is driven in any race, speed test, rally or contest;

d) the vehicle is driven by anyone not named or described in this agreement as a person permitted to drive the vehicle;

e) the vehicle is driven by an unlicensed person;

f) the vehicle is wilfully or recklessly damaged or lost by the hirer, a nominated driver, or a person under the hirer’s authority;

g) the driver is convicted of a traffic offence while driving the vehicle;

h) the vehicle was being driven on any of the following roads:

Skippers Road (Queenstown)

Ninety-Mile Beach (Northland)

i) the vehicle was operated outside the terms of this agreement or any agreed extension of this agreement

j) failure to complete an insurance claim form within 24 hours of an accident may make the hirer totally liable.

k) the vehicle is driven in water or on beaches

If these conditions are breached you may be required to pay up to the full cost of replacement for the vehicle. If any major repairs are required, the hirer must contact CamperCo immediately, and failure to do so may jeopardise any claim that comes about following the conclusion of the hire period.

  1. It is agreed between the hirer and the operator that section 11 of the Insurance Reform Act 1977 shall apply with respect to the above exclusions as if this clause constituted a contract of insurance.
  2. The hirer agrees that if any loss or damage is caused to the vehicle in any of the circumstances of the above Insurance Exclusions and the hirer allows the circumstances to arise or could reasonably have been expected to prevent it from arising, the hirer will be liable to the operator for any loss or damage to the vehicle during the term of hire and any extensions to the term, however caused, and for any consequential loss or damage.

11) Mechanical Repairs and Accidents

If the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the hirer shall notify the operator of the full circumstances immediately.

  1. The hirer shall not arrange or undertake any repairs or salvage without the operator’s authority except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property.
  2. If the vehicle requires repair or replacement the operator shall at his/her discretion endeavour to repair or replace the vehicle.
  3. In the event that an accident renders the vehicle un-roadworthy, the operator will make no refund of unused hire period and the provision of a replacement vehicle shall be at the operator’s sole discretion. In these circumstances the operator shall not be responsible for the cost of transporting the hirer and any accompanying passengers away from the accident location, or responsible for any accommodation costs.
 

 

 

15) Infringements

The hirer is advised that Section 9.5(1) of the Land Transport Rule Operator Licensing 2007 permits the operator to debit the hirer’s credit card for any infringement fee where the offence was committed during the period of hire and was a speeding offence, a toll offence or an offence in respect of failure to comply with the directions given by a traffic signal where that offence was detected by approved vehicle surveillance equipment, or an offence for parking in any position of a road in breach of any bylaw of a road controlling authority or an offence against Part 6 of the Land Transport (Road User) Rule 2004. The operator may also charge an administration fee in addition to the traffic offence charge.

 

  1. The hirer is advised that should the operator decide to debit their credit card for a traffic infringement, the hirer has the right to:receive a copy of the infringement notice and any reminder notice as soon as practicable after it is received by the operator;challenge, complain about, query or object to the alleged offence to the issuing enforcement authority; seek a court hearing (within 56 days from the date of issue of the infringement notice or 28 days from the date of issue of the reminder notice); and dispute the matter with the credit card issuer

A fine paid by Camperco on behalf of the hirer can incur a $20 admin fee.

17) Return of vehicle

a) Vans will be clean when hired and should be reasonably clean before return. If they are not reasonably clean, a $200 cleaning fee can be charged.

b) Vans will be hired with a full tank of fuel and are to be returned full. If they are not full when returned a $60.00 filling fee will be charged.

c) Vans will be hired with a full bottle of LPG gas and are to be returned full. If they are not full when returned a $50.00 filling fee will be charged.

d) Vans will be hired with an empty and clean toilet and should be returned with an empty and clean toilet. If the toilet is not empty upon return a $100 cleaning fee will be charged. 

e) Vans will be hired with an empty grey wastewater tank and should be returned with an empty grey wastewater tank. If the grey wastewater is not empty upon return a $100 cleaning fee will be charged.

f) All fridges should be turned off when dropped off.

g) On return we will inspect the vehicle for damage and that the contents are complete and not damaged. The hirer will be liable for any new defects or missing items.

NB: Gas Cooker:

Great care must be taken when using these cookers as the gas is highly flammable. Never use unattended and ensure they are fully turned off after use. Camping style portable cookers must be outside the vehicle. 

18) Special Conditions

The rental prices and fit out of CamperCo campervans may be subject to change at any time due to upgrades, modifications or conditions out of our control. If prices do change, any customer who has made a booking will be notified immediately.

The rental agreement is a legal binding document which must be signed before any campervan is hired.

 

THE OPERATOR MUST GIVE YOU AT LEAST ONE COPY OF THIS AGREEMENT WHICH MUST BE KEPT IN THE VEHICLE THROUGHOUT THE TERM OF THE HIRE AND PRODUCED ON DEMAND TO AN ENFORCEMENT OFFICER.
